C. ROTHWELL THERAPY

1. Introduction

These Terms and Conditions govern the provision of remote mental health therapy by C. Rothwell Therapy, a sole trader and qualified, accredited psychotherapist. By booking or attending a session, you confirm that you are at least 18 years of age and agree to the terms outlined below. Additionally, you are agreeing to therapeutic support delivered by Caroline Rothwell (referred to as ‘I’ or ‘me’).

To ensure the client-therapist relationship begins on a positive note, these terms outline the information about services, ensuring you are clear about what therapeutic support involves and how it will be delivered. It also outlines what you can expect from me and what I expect from you. You will be asked to sign this agreement, read and agree to the privacy policy, complete a questionnaire and return it in advance of our first session, so I may understand your needs effectively.

 

2. Services

2.1. Sessions are delivered exclusively online via secure video link (TEAMS) or telephone. It is your responsibility to have a reliable internet connection and a quiet and private place in which to engage in sessions.

2.2. The therapeutic services I shall deliver as part of your support includes: Mindfulness Cognitive Behavioural Therapy, Holistic Person Centered Counselling, non-medical Menopause Symptom Support and advocacy, Bereavement and Grief support, Psychological Cancer Care Support, Stress and Anger Management, Life Coaching, Chronic Pain Management, Living with Long Term Conditions and coping with the psychological impact this can have, Suicide Ideation and Prevention, Fear and Sadness, Anxiety and Depression, Workplace Stress and Wellbeing.

2.3. Appropriate breaks for annual leave and during holiday periods, such as Christmas/New Year/Summer, are expected. Alternative dates will be offered to support you in accessing your allocated sessions at more convenient times.

2.4. I shall confirm the date and time of our sessions with you. It will be your responsibility to ensure that you are aware of your session time and arrive on time. If I have not booked your next session, it shall be your responsibility to contact me within 72 of your preferred date, as payment is taken via bank transfer, in advance and needs time to clear.

2.5. If I am required to cancel or reschedule, I shall make all reasonable attempts to provide you with as much notice as possible and to reschedule your session within a reasonable timeframe. 

2.6. You agree and accept that if you fail to attend a session, or fail to give 48 hours’ notice that you are unable to participate in a scheduled session, you shall simply forfeit the right to that session. Fees paid are not refundable.

 

3. Qualifications and Accreditation

I am registered and accredited by the British Psychological Society and ACCPH. All work complies with ethical codes and continuing professional development requirements. Therapy is provided in accordance with professional guidelines (BPS, ACCPH) and NICE.

 

4. Client Eligibility and Your Obligations

4.1 Clients must be aged 18 or over and are responsible for ensuring a private, safe space and reliable internet or telephone connection for each session.

4.2. You accept and acknowledge that entering into this Agreement does not establish any form of legal business relationship and that I am only liable to you in respect of the Services provided and to the extent as set out here.

4.3. You accept that as part of your participation in the therapeutic support that you may be required to review and make decisions concerning your personal and home life, business and career, finances, lifestyle, education and development, health and illness and that any such reviews, subsequent decisions, implementations and actions will be your sole responsibility.

4.4. You accept and understand that participation in the therapeutic support doesn’t guarantee success or results and that you are solely responsible for making decisions and taking appropriate action as a result of therapeutic support.

4.5. As part of the therapeutic support, you will have access to information and resources, designed to benefit you and I shall not be liable for your failure to engage with or to put into place plans or strategies, or for any results, whether direct or indirect, arising out of your participation in therapeutic support or delivery of it.

4.6. You accept and understand that purchasing therapeutic support is not a substitute for professional medical intervention or services. Suppose you are currently undergoing medical or other professional help concerning your mental health. It is your responsibility to provide your practitioner with the details of this therapeutic support and let me know if appropriate and relevant.

4.7. You agree that you DO NOT experience epilepsy, psychotic episodes, or have a psychiatric disorder such as a Personality Disorder, Bipolar Disorder or Schizophrenia. You should seek help from the NHS psychiatric services via your GP if this is the case.

4.8. You accept and understand that you are responsible for attending the sessions at the scheduled time and during the session to participate fully and communicate honestly and openly.

4.9. You understand and acknowledge that the therapeutic sessions will combine 1-1 support and self-guided resources. You agree to conduct yourself reasonably and responsibly at all times during sessions and not act in a manner which may cause offence, distress or alarm. At my discretion, your sessions may be terminated if you do not comply.

4.10. Should you have any concerns about the delivery of the therapeutic support you receive, you agree to provide details via email to me as soon as possible. I agree to use reasonable efforts to work with you to resolve any concerns you have.

4.11. You understand that, once signed, this Agreement can only be cancelled or terminated by the relevant provisions contained within this Agreement and that no refunds apply.

4.12. You understand that any information you provide is accurate, correct, up-to-date, and complete.

4.13. You understand that any resources or information that I provided you as part of this therapeutic support is for general information only and does not constitute legal, financial or medical advice.

4.14. You agree that all information I disclose to you as part of the therapeutic process remains my intellectual property. You agree to comply with our rights in connection with the information, materials, and resources I provide to you, as outlined in Section 4.5.

4.15. You agree and understand that Caroline Rothwell is a qualified Psychotherapist, Mindfulness Cognitive Behavioural Therapist and trained in therapeutic approaches as mentioned in point 3 of these Terms and Conditions.

4.16. If you change your contact details, it will be your responsibility to notify me so that I can update your information accordingly.

4.17. It is your responsibility to inform me of any upcoming annual leave so we may reschedule appointments.

4.18. You agree that I have made no other representations to induce you into purchasing the therapeutic services and no modification to this Agreement shall be effective unless in writing and signed by us both.

 

5. My Obligation to You

5.1. I agree to deliver therapeutic support to you with the utmost care, skill and unconditional regard, without judgment or prejudice.

5.2. I agree to attend our sessions with a commitment to your success.

5.3. If I need to cancel a session, I will endeavour to provide you with as much notice as possible and reschedule the session for a mutually agreeable time.

5.4. To provide a safe, supportive, non-judgmental environment. 

5.5. To work within clinical governance and ethical frameworks. To adhere to data protection and confidentiality obligations.

 

6. Fees and Refunds

6.1. Session fees: £70 per 60-minute session.

6.2. Payment shall be made by bank transfer in full, no later than 48 hours BEFORE the scheduled session.

6.3. Cancellation of sessions must be made with 48 hours' notice; otherwise, charges paid are not refundable.

6.4. No-shows are charged in full. No refund applies.

6.5. The fee shall be paid without any deduction or any withholding except as may be required by law.

6.6. Your first Assessment Session is free of charge if all relevant paperwork is signed and returned before the scheduled date and time of your session.

 

7. Cancellation and Termination

7.1. This agreement between us may be terminated by either one of us giving the other notice by email in the following circumstances:

7.2: Either one of us breaches a term of this Agreement, and where it is a breach capable of remedy, fails to remedy that breach within 14 days of being notified by the other person or:

7.3. Either one of us breaches a term of this Agreement which is incapable of being remedied, or:

7.4 You provide us with 14 days’ notice to cancel this Agreement. Please note that no refunds are available, and you will be liable for the full payment of the Fee even if you provide notice of cancellation.

7.5. I reserve the right to limit delivery of therapeutic support if I reasonably determine that you are: preventing me from delivering the therapeutic support in any way. Behaviour such as displaying a lack of interest in the support, repeatedly ignoring or failing to respond to emails or other messages or communicating in a way which is abusive or intended to offend.

7.6. Upon termination of this Agreement for any reason, any fee or other monies owing to me, shall become immediately due and payable.

 

8. Events Outside of Our Control

8.1. Whilst I shall make every effort to deliver the therapeutic support to you, certain events may arise which are outside of my control and which may affect my ability to provide therapeutic support. Such events may include an Act of God, Strike, War, Riots, Lockouts, Fire, Flood, Accident, any other circumstances beyond our control (“Events’). 

8.2. Should an Event occur, then the timescales for delivery of the therapeutic support shall be extended until a reasonable time after the Event, and under no circumstances shall I be liable for any loss or damage suffered by you as a result.

8.3. I acknowledge the importance of telecommunications to the delivery of the therapeutic support and agree to seek alternative arrangements to limit any delay caused by issues or failures caused by telecommunication services.

 

9. Confidentiality, Intellectual Property and Data Protection

9.1 For this agreement, confidential information shall mean personal information, ideas, any practices, materials, content, resources, workbooks or any other confidential or proprietary information.

9.2. For you to benefit fully from therapeutic support, you accept that you will be encouraged to disclose personal data and or confidential information. I understand and respect the value of such information and shall not, either directly or indirectly, communicate or disclose, make available or use for my benefit or the benefit of others anything we discuss in sessions unless I deem you are at risk of harming yourself or others.

9.3. Where I process your data, I shall do so by the GDPR terms and conditions.

9.4. I am grateful to receive testimonials, comments and reviews. As part of this Agreement, you consent for me to exhibit, copy, publish, distribute, use on or in any of my websites, pages, other social media sites, advertising, marketing campaigns or email communications any of these reviews as I reasonably require to promote my business lawfully. I will do this using an alias so your identity remains confidential. You can withdraw your consent at any time by emailing me.

9.5. You agree not to use any of our confidential information or other materials or resources for any unlawful purposes, that would cause harm or distress to another person, or that would damage Caroline’s reputation or business.

 

10. Limitations and Liabilities

10.1. The Therapist cannot guarantee specific outcomes; therapy effectiveness varies individually.

10.2. Liability is limited to a refund of any session fees where I have materially breached these Terms.

10.3. I have made every effort to represent the therapeutic support and services accurately.

10.4. Any testimonials/and/or examples of results experienced are not intended to represent or guarantee that anyone will achieve similar results under any circumstances, against any costs, liability, damage, loss, expense, or claims that I incur as a result of your default or violation of any term of this Agreement.

10.5. You agree to indemnify me against any cost, liability, damages, loss, expenses, or claims that I incur as a result of your default or violation of any terms of this Agreement.

10.6. Each individual’s progress and results depend on many factors, including his or her background, dedication, motivation and desire. I make no guarantee, representation or warranty of the Service provided.

 

11. Complaints

11.1. Any concerns should be raised first with me directly.

11.2. If unresolved, you may contact the British Psychological Society’s Professional Conduct department.

 

12. Termination

12.1. Either party may end therapy with two weeks’ notice.

12.2. Sessions already paid for will be honoured or refunded pro rata.

 

13. Governing Law

13.1 The laws of England and Wales govern these Terms.
